Animal Control in Avalon

  

A few residents have commented on or noted the stray cats which seem to wander throughout the neighborhood and have either made note of the concern for the health and well being of those animals or noted that some of them are pests in the neighborhood, shedding on porches and harassing pets or wild life on their property. In response to these concerns, the Board would like to share the following guidance. 

Our Local Position: The Covenants

The Avalon HOA Board acts in alignment with our covenants in so far as they do not conflict with local, state, or federal law. Specifically as it concerns the maintenance and care of pets, the covenants note the following in Article 11, Section 9:


Pets, Livestock and Poultry. No animals, livestock or poultry of any kind shall be raised, bred or kept on any Lot, except for cats, dogs or other generally recognized household pets of a reasonable number, provided that they are not kept, bred, or maintained for any commercial purpose; and provided further, than no more than three (3) adult animals may be kept on a single Lot except for newborn offspring of such household pets which are under nine (9) months of ages. All such animals shall be kept in strict accordance with all local laws and ordinances (including leash laws) and in accordance with all rules established by the AVALON HOMEOWNERS’ ASSOCIATION, INC.

As you can see, we have no governing rule on keeping pets which would force residents to keep their cats solely on their property. 

County Ordinance

Next, we look at the county regulation:

What can I do about an animal running loose around my property?

Cats:

Cats are no longer subject to the restraint and confine portion of the new County Ordinance.  Lexington County has changed the ordinance regarding cats and has entered a partnership with Pawmetto Lifeline to address the stray cat population and reduce the euthanasia rate. All Lexington County residents are being referred to Pawmetto Lifeline for more information on the community cat program and how to participate in trap, neuter, and release.

Current Ruling

As Lexington County has ruled on the matter, we default to their decision and concur that the right solution is a trap, neuter, and release program, when and where applicable.
